This module deals with the external and the internal history of South African law. In study unit 1 we introduced you to the history and the sources of South African law, the courts in South Africa and their officers, the doctrine of stare decisis, the interpretation of statutes, and court judgments. The first learning unit concludes with an overview of the development of South African law’s three components: African, Western, and Universal. Knowledge of historical events is vital for understanding the evolution of South African law. South African lawyers can use different sources, including legal history, to answer legal questions. Our legal history links us to other countries = South African legal system shares a common legal history with countries like Britain, thus their legal history is linked. STUDY UNIT 1 SOUTH AFRICAN LEGAL SYSTEM AIM OF STUDY UNIT: After having studied this study unit you should be able to understand the different origins and sources of South African Law, the South African court structure and the doctrine of stare decises. The document provides an overview of key concepts in South African law. It discusses: 1) The definition of law as a system of norms and rules that governs behavior in society and is enforced by the state. It explains the main divisions of public law, private law, formal law, and substantive law. 2) The distinction between law and rights. Purpose: The purpose of this module is to provide students with an outline of the origins of the South African legal system focussing on the indigenous African, Western and human-rights traditions. Law: A system of rules enforced by the state to regulate behaviour. Example: standards. Rights: Entitlements or freedoms guaranteed to individuals. Example: be unfairly discriminated against. 1. Real Rights: Rights over a thing (e., ownership of a car). Example: If you own a house, you have the right to use, sell, or lease it.
